These Terms of Service (the "Agreement") are entered into by and between RealFine.ai, LLC ("RealFine.ai") and the person or entity on whose behalf the Services (as defined below) are used or accessed (the "Subscriber") governing our platform services, including our programs, features, account portals, and technical support (the "Services").

If you do not agree to this Agreement, you are prohibited from using or accessing our Services. Realfine.ai may modify these terms at any time by posting the revised terms to our website, [realfine.ai](https://realfine.ai). Your continued use of our Service means that you have accepted the changed terms.

TERMS

  • Acceptance of Terms: Users must agree to the terms to use the services of Realfine.ai. Terms may be updated regularly on the Realfine.ai website.

  • General Use: Limited permission is granted to access and display web pages from the Realfine.ai site, subject to certain conditions.

  • Compliance with Telemarketing Laws: Subscribers must adhere to laws governing automated or prerecorded calls or texts, such as the Telephone Consumer Protection Act and Telemarketing Sales Rule.

  • Consent and Record Keeping: Necessary consent for communications must be obtained and recorded by subscribers.

  • Subscriber Data: A non-exclusive, worldwide license is granted to Realfine.ai to use subscriber data in connection with the services.

  • Confidentiality: Both parties agree to maintain the confidentiality of information shared during service performance.

  • Indemnification: Subscribers must indemnify Realfine.ai against claims arising from service use or agreement breach.

  • Warranty Disclaimer: Realfine.ai provides services "as is" without warranties or guarantees.

  • Limitation of Liability: Liability of Realfine.ai in connection with services or the agreement is limited.

  • Compliance with Law: Services must be used in compliance with all applicable laws and regulations.

  • Third-Party Content and Sites: Interaction with third-party services is not the responsibility of Realfine.ai.

  • Dispute Resolution: Disputes under the agreement are resolved through arbitration in accordance with American Arbitration Association rules.

  • Governing Law: The agreement is governed by the laws of the state where Realfine.ai is headquartered.

  • Severability and Survivability: If any provision is unenforceable, the rest remain in effect. Certain provisions survive agreement termination.

  • Waiver: No waiver of any term is deemed a waiver of any other term.

  • Miscellaneous: Both parties warrant legal power to enter the agreement. It is binding upon parties and their successors and assigns.

  • Export Laws and International Privacy: Compliance with U.S. and applicable export laws and regulations, particularly regarding international data privacy, is required.

  • Relationship of the Parties: Realfine.ai and the subscriber are independent contractors under the agreement.
